JUSTICE SUDHIR SINGH ORAL ORDER 23-09-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 395, 396 and 397 of the Indian Penal Code. Allegation is that dacoity was committed in the house of informant by 20-25 accused persons and in course of dacoity, the dacoits assaulted informant, his son, wife and others. Informant's son died due to assault.
It has been submitted on behalf of the petitioners that they are in custody since 30.4.2016. Chargesheet has been submitted against the petitioners. No allegation of tampering of witnesses is alleged against the petitioners. Petitioners are not named in the F.I.R. They have not been put on T.I.P. to ascertain their implication in the present case. There is no recovery of any incriminating article from the possession of the petitioners. The name of the petitioners has come in the confessional statement of the co-accused. Other co-accused has been granted bail vide Cr. Misc. no. 26155 of 2016.
On behalf of the State, it is submitted that petitioners are
Patna High Court Cr.Misc. No.33470 of 2016 (3) dt.23-09-2016 2/2 not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate-VII, Saran, Chapra. in connection with Doriganj P.S. Case no. 96 of 2015.
