Public Prosecutor for the State and also heard learned counsel for the informant.
Again, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Session trial no. 114/2016 arising out of Rajpur P.S. Case no. 121/2011 pending in the court of Addl. Sessions Judge VI, Buxar stands rejected. However, it is informed that almost all prosecution witnesses except one Shyam Bihari Rai, have already been examined and trial of the petitioner is on the verge of conclusion. It is also informed that the aforesaid witness Shyam Bihari Rai (I.O) was examined but for cross-examination, he has not turned up for the last three/ four dates.
Let copy of this order be sent to Superintendent of Police, Buxar with direction to him to ensure the presence of witness Shyam
Patna High Court Cr.Misc. No.14119 of 2017 (3) dt.10-05-2017 Bihari Rai within four weeks from the date of receipt/production of a copy of this order, failing which matter shall be viewed seriously. Trial court is directed to conclude the trial of the petitioner within four months from the date of closer of the prosecution evidence.
