17-08-2016 Heard Sri Karandeep Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 31-03-2016 in Kalyanpur P.S. Case No. 39 of 2016, corresponding to Sessions Trial No. 482 of 2016 registered for the offence under Sections 341, 323, 324, 307, 379/34 of the Indian Penal Code, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that it is true that in the F.I.R., the informant had alleged that petitioner gave Farsa blow over his head, but fact remains that injury on the head was found to be simple in nature. According to learned counsel for the petitioner, entire family members of the petitioner have been arrayed as accused in the F.I.R. He submits

In view of nature of accusation and period of custody, let the petitioner namely Ram Pravesh Ram @ Bundel Ram be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge 4th, Motihari, East Champaran in connection with Kalyanpur P.S. Case No. 39 of 2016, with a condition that one of the bailor must be blood relation of the petitioner and secondly, during the trial on each and every date, the petitioner shall remain physically present. If continuously on two dates, the petitioner fails to appear before the court below, without prior permission of the trial court, his bailbond shall stand automatically cancelled. (Rakesh Kumar, J.)
