The petitioners apprehend their arrest in Bahadurganj P.S. Case No. 58 of 2014, registered for the offences punishable under Section 307 and other sections of the Indian Penal Code. Later on Sections 302 and 504/34 of the Indian Penal Code were added.

The informant made allegation against all the petitioners that they assaulted his father Gaina Lal and subsequently his father became unconscious. The father of the informant was referred to Sadar Hospital, Kishanganj and after C.T. Scan his father was sent to home but the condition of his

Patna High Court Cr.Misc. No.16546 of 2015 (2) dt.01-05-2015 father deteriorated and became serious. After sometime the father of the informant died.

It is submitted that from perusal of the First Information Report itself, it would appear that there was no intention on the part of the accused persons to kill the deceased. During the course of investigation, the witnesses have stated that the deceased fell down and got injuries.

There appears that Gaina Lal got many injuries all over his body. He also got injuries on the head and on account of the same the death was caused.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the prayer for anticipatory bail of the above named petitioners is rejected in connection with Bahadurganj P.S. Case No. 58 of 2014, pending in the court of the learned Chief Judicial Magistrate, Kishanganj.
