The petitioner seeks regular bail in connection with Piprakothi P.S. Case No. 126 of 2015, registered for the offence punishable under Sections 304B and 34 of the Indian Penal Code.

The allegation is regarding the petitioner and other accused persons having done away with the victim lady, who is the wife of the petitioner herein.

The learned counsel for the petitioner submits that a bare perusal of the entire case dairy would show that the witnesses, who have deposed before the police during the course of investigation, have more or less stated that the victim lady had committed suicide. It is further submitted that the medical report

Patna High Court Cr.Misc. No.24537 of 2018(3) dt.03-07-2018 2/2 would show that there is no sign of strangulation. The petitioner is stated to be having a clean antecedent and he is languishing in custody since 04.09.2017.

Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Piprakothi P.S. Case No. 126 of 2015.
