Petitioners seek bail in a case registered under sections 392/411 of the Indian Penal Code.
Petitioners are not named in the first information report but in course of investigation, the name of petitioner no.1 came in this case on the basis of information furnished by spy of police and thereafter, petitioner no.1 was arrested and made his confessional statement naming petitioner no.2 and others.
It appears that except confessional statement as well as some criminal antecedent, there is nothing against these petitioners. The recovery of looted sim is said to have been made from the house of another accused and so far as motorcycle is concerned, the same was recovered from an abandoned place.
Patna High Court Cr.Misc. No.33246 of 2016 (4) dt.15-12-2016 Petitioners are in jail custody since 21.9.2016 and investigation against them has already been completed. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of Sri Ashok Kumar II, Judicial Magistrate, Ist Class, Uda-kishunganj District Madhepura/ concerned court in Chausa P.S. Case no. 178/2014.
