ANJANA MISHRA ORAL ORDER 11-12-2015 Heard learned counsel for the petitioner and learned counsel for the Opposite party no. 2.

The petitioner apprehends his arrest in connection with Rupaspur P.S. Case No. 252 of 2014 registered for the offences punishable under Sections 498A/34 of the Indian Penal Code. Earlier the matter had been referred to Mediation Center and a report dated 14.12.2015 has been received from the Mediator stating therein that the dispute between the parties has been resolved through mediation process and the terms of settlement are appended to the said report.

Considering the facts and circumstances of the case and the also the mediation report, let the petitioner above named, in the event of his arrest or surrender before the court below within a

Patna High Court Cr.Misc. No.22612 of 2015 (5) dt.11-12-2015 period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Danapur Patna in connection with Rupaspur P.S. Case No. 252 of 14, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

However, it is made clear that if any of the terms of settlement are not complied with, it shall be open for the parties to move the court below for redressal of their grievance, if any. (Anjana Mishra, J) Jagdish/- U T
