2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 103(1), 61(2) of the Bharatiya Nyaya Sanhita and Section 27 of the Arms Act.
3. As per prosecution case, some unknown miscreants committed murder of the husband of informant.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. Petitioner is not named in the F.I.R. and his name surfaced during course of investigation in confessional statement of co-accused. During course of investigation, injured Guddu Singh was also examined by the police but he also did not name this petitioner as the assailant. Similarly situated co-accused persons have already
Patna High Court CR. MISC. No.38199 of 2026(2) dt.25-06-2026 2/2 been granted anticipatory bail by this Court vide order dated 09.02.2026 passed in Cr. Misc. No. 85604 of 2025. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and other facts and circumstances of the case, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Muzaffarpur in connection with Muzaffarpur Sadar P. S. Case No. 419 of 2025, subject to condition as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
