Petitioner seeks bail in a case registered for the offence punishable under Section 395 of the Indian Penal Code.
The FIR of the occurrence of dacoity is against ten unknown persons.
Submission is that the petitioner is in custody since 21.07.2017. He was never put on T.I. Parade during investigation nor anything has been recovered from his possession. Petitioner has filed supplementary affidavit that though the petitioner is named accused in six other criminal cases. However, all those cases were registered against unknown and name of the petitioner was dragged in the confessional statement of the co-accused like in the
Patna High Court Cr.Misc. No.4796 of 2018 (7) dt.08-05-2018 present case.
Considering the aforesaid material, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T.No.427 of 2017 arising out of Arwal Police Station Case No.60 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
