2. Petitioners apprehend arrest in a case registered for the offence punishable under Sections 323 , 379, 498(A) , 504 and 34 of the Indian Penal Code and 3/ 4 of the D. P Act. 3 . As per complaint case , marriage of the complainant was solemnized with this petitioner Md. Murtuza on 6.5.18 and
Patna High Court CR. MISC. No.41843 of 2025(2) dt.31-07-2025 2/3 thereafter, it is alleged that all the F.I.R. named accused persons including this petitioner tortured and harassed the complainant due to non-fulfillment of demand of dowry and eventually, ousted her from the matrimonial house .
4. Learned counsel for the petitioner submits that petitioner is husband of the vicitm. During pendency of the case , to the intervention of well-wishers of both parties, the case has been compromised, and for the same , a compromise petition has been filed in the court below 10.07.2025 . Petitioner claims clean antecedent.
5 . Learned counsel for the informant and learned APP for the State does not controvert the contention made on behalf of petitioner.
6. Considering the fact that thrust of accusation is against husband of the complainant, this anticipatory bail is allowed and it is ordered that let the above named petitioners in the event of their arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Vaishali at Hajipur in connection with Complaint Case No. 1198 of 2022 , subject to condition as
