The petitioner seeks regular bail in connection with Tariyani Chhapra PS case no. 1 of 2018 instituted for the offences punishable under Sections 341, 342, 323, 376/34 of Indian Penal Code.

The allegation is regarding the petitioner herein having abducted the informant and her daughter, taken them away and subsequently, the accused persons, after assaulting the informant and her daughter, had left them at Humra Chowki. The learned counsel for the petitioner submits that the informant was having relationship with the petitioner from before and had been continuously in touch with the petitioner. It is

No.26318 of 2018 (5) dt.06-07-2018 2/2 further submitted that admittedly, land dispute was going on in between the parties and the informant had taken money from the petitioner but had not executed the sale deed in favour of the wife of the petitioner, for which the petitioner had also filed an informatory petition. The petitioner is stated to be languishing in custody since 14.02.2017 and he has a clean antecedent. Having regard to the facts and circumstances of the case as also the materials available in the case diary, I feel that there is no impediment in grant of regular bail to the petitioner. Accordingly, the abovenamed petitioner is directed to be released on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of S.D.J.M. Shivhar in connection with Tariyani (Chhapra) PS case no. 1 of 2018.
