The petitioners apprehend their arrest in Bidupur P.S. Case No. 178 of 2016, registered for the offences punishable under Sections 353 and other Sections of the Indian Penal Code. The informant alleged that when the police officials had gone to block the road constructed on the private land in pursuance of the order of the Commissioner, Tirhut Sub-division, Muzaffarpur in PLDR Appeal No. 608/2013, many persons

Patna High Court Cr.Misc. No.35421 of 2016 (3) dt.29-09-2016 2/2 assembled there and assaulted the police officials with spade and other lethal weapons.

It is submitted that Krishna Kumar Yadav, ASI was assaulted by the mob but he got simple injury. No lethal weapon was used. In fact, some scuffle took place and the police officials came to block the road and the villagers standing there objected the police officials.

Considering the nature of allegation made against the petitioners and the fact that Krishna Kumar Yadav, ASI got simple injuries i.e. bruise and laceration, petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 178 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
