The Petitioner seeks bail in Noorsarai P.S. Case No. 284 of 2016 instituted for the offence under Section(s) 302/34 of the Indian Penal Code and Section 27of the Arms Act. As per written report, co-accused Shrawan Yadav fired with pistol on the temple of Mukhiya Jee which hit in his chick whereas co-accused Dinesh Yadav fired with pistol which caused injury on the arm. Thereafter co-accused Shrawan Yadav and Kamlesh Yadav fired with his pistol which caused injury on the waist of Mukhiya Jee.
It has been submitted on behalf of the petitioner that petitioner is not named in the written report. The
Patna High Court Cr.Misc. No.19094 of 2017 (2) dt.03-05-2017 2/2 name of the petitioner has come during investigation on the confessional statement of co-accused Ranjeet Kumar Yadav. Learned Sessions Judge has mentioned in the impugned order that in para 117 of the case diary the name of the petitioner has figured in the confessional statement of co-accused Ranjeet Kumar Yadav.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the Petitioner, above named, be released on bail on furnishing bail bond of 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Nalanda at Biharsharif in connection with Noorsarai P.S. Case No. 284 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) Shageer/- U T
