The petitioner seeks bail in Bochaha P.S. Case No.89 of 2016 instituted for the offence under Sections 25(1-B)a, 26(ii)/35 of the Arms Act.

It is alleged that one loaded country made pistol has been recovered from the possession of the petitioner. The petitioner is said to be in custody since 4.7.2016. It has been submitted that the trial has not commenced till date in the lower court.

In such circumstances, considering the period spent by the petitioner in custody, he is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two

Patna High Court Cr.Misc. No.4336 of 2017 (2) dt.10-02-2017 sureties of the like amount each to the satisfaction of learned A.C.J.M.-Cum-Sub-Judge-11th, Muzaffarpur in connection with Bochaha P.S. Case No.89 of 2016, subject to the conditions that both the bailors shall be the close relative of the petitioner and further the petitioner will remain present in court on each and every date during the trial and in the event of default on any subsequent two dates the court below will cancel the bail bond of the petitioner.
