Petitioner is languishing in custody for the offences punishable under Section 392 of the Indian Penal Code. This is a case of misuse of privilege of bail. The bail bond of the petitioner was cancelled in the year 2013 and he was declared absconder in the year 2016 without any service report. Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional District & Sessions Judge, Nawadah/Successor Court, in connection with Sessions Trial No.17 of 2009/457 of 2014, arising out of Sirdalla P.S. Case

Patna High Court Cr.Misc. No.12657 of 2017 (3) dt.28-03-2017 No.100 of 2007, subject to the condition that both the bailors shall be local resident within the territorial jurisdiction of the court below and subject to the further condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case and take him into custody till conclusion of the trial.
