Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and Section 27 of Arms Act.
One Sajjan Shekhar alongwith the deceased were going on motorcycle. Two named persons committed murder of the deceased in presence of Sajjan Shekhar, who disclosed the same to the informant. Thereafter, FIR was lodged. The Laptop of Sajjan Shekhar was taken away by the assailant Abhimanyu. Rohit confessed before the police that Laptop is in the house of this petitioner. Thereafter, Laptop was recovered from possession of the petitioner. Thereafter, the petitioner confessed that the Laptop was kept by Abhimanyu.
The petitioner is in custody
Patna High Court Cr.Misc. No.10710 of 2018 (2) dt.23-02-2018 since 21.11.2017. Petitioner has got no criminal antecedent. Considering the entire facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Phulwaria Police Station Case No.128 of 2017, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
