The grievance of the petitioner is that despite lodging information about the commission of a cognizable offence, the officer-in-charge of the Upahara Police Station in the district of Aurangabad has not registered FIR.
Learned counsel for the State has submitted that the petitioner gave a written application to the SHO Upahara Police
Patna High Court Cr. WJC No.1022 of 2013 (2) dt.05-01-2015 2/2 Station on 12th March, 2014 and on that basis Upahara P.S. Case No.12 of 2014 has already been registered for the offence punishable under section 379 of the Indian Penal Code and the said case is being investigated upon.
In view of the statement made by the learned counsel for the State at the Bar, I find no merit in the present writ petition. Accordingly, the writ petition is dismissed.
