ANJANA MISHRA ORAL ORDER 17-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 420, 468/34 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner is not named in the FIR. He further submits that the name of the petitioner has surfaced in the confessional statement of one co-accused, namely, Bablu Singh but the police without proper investigation has proceeded against the petitioner. It is further submitted that the confessional statement before the police has no evidentiary value.

Considering the fact that the name of the petitioner has surfaced in the confessional statement of one co-accused, let the above named petitioner, in the event of his arrest or surrender in

Patna High Court Cr.Misc. No.21286 of 2015 (3) dt.17-09-2015 2/2 the court below within a period of three weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.,Bagha, District- West Champaran in connection with Gobardhan P.S.Case No. 12 of 2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
