Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 307, 323, 341, 384, 504 of the Indian Penal Code and Section 27 of the Arms Act.

It is alleged that eleven accused persons including the petitioner came and demanded rupees five lacs extortion and threatened not to allow the construction work to continue without payment. On 30.11.2014 the accused persons including the petitioner came and abused and asked to stop the work when Raj Kumar Mistri assaulted with the butt of the pistol to Nand Kumar on his head causing bleeding injury. Coaccused Deepak Kumar @ Bittu assaulted to Ramdil Mahato with iron rod on his head and Bajrangi Mistri assaulted with lathi to Sonajhari Devi when others assaulted other persons of

Patna High Court Cr.Misc. No.24422 of 2015 (2) dt.30-06-2015 2/2 the informant's side.

It is submitted by learned counsel for the petitioner that in the background of pending Title Suit No. 194 of 2014 between co-accused Raj Kumar Mistri and the informant the accusation has been levelled. The accusation is omnibus and general against the petitioner. The specific accusation of assault is against Raj Kumar Mistri, Deepak Kumar and Bajrangi Mistri.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Danapur in connection with Bihta P.S. Case No. 893 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
