Petitioner, already in custody, seeks bail in connection with Narpatganj PS Case No.495 of 2017, registered under Sections 341, 323, 342 and 392 of the Indian Penal Code. Petitioner is not named in the FIR, he and others relieved the informant of cash to the tune of Rs.2,79,000/- . Learned counsel for the petitioner submits that the petitioner is acquainted with the informant and due to some other reason has been falsely implicated in this case. However, except his confessional statement, subsequent to that nothing has been recovered from possession of the petitioner, he has no criminal antecedent and the petitioner has remained in custody for six months.

No.12439 of 2018(4) dt.07-05-2018 2/2 Having considered the aforesaid facts and circumstances, petitioner Rewati Yadav is directed to be released on bail on furnishing bail bond of Rs.25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Narpatganj PS Case No.495 of 2017 with following conditions:

(1) One of the bailors must be the close family member of the petitioner.

(2) The petitioner shall remain physically present on each and every date before the trial court as and when required and if he absents himself on two consecutive dates without any reasonable cause, his bail bond shall liable to be cancelled. (Arun Kumar, J) S.KUMAR/- U T
