For the Opposite Party/s : Mr. Ganesh Prasad Singh, APP. ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 20-08-2016 This is an application, made under Section 439 of the Code of Criminal Procedure, seeking bail for the accusedpetitioner, namely, Rakesh Choudhary, in connection with Sahar Police Station Case No. 134 of 2014, under Sections 341, 323, 354, 379, 504 of the Indian Penal Code.
Perused the above application and materials on record.
Heard Mr. Bachan Jee Ojha, learned Counsel for the petitioner, and Mr. Ganesh Prasad Singh, learned Additional Public Prosecutor, appearing on behalf of the State. Considering the nature of incriminating materials available against the accused above-named and the fact that five witnesses have already been examined, this Court is of the view that, at this stage, the accused above-named shall not be allowed
Patna High Court Cr.Misc. No.35840 of 2016 (2) dt.20-08-2016 2/2 to go on bail.
In view of the above and in the interest of justice, the prayer for bail is hereby rejected at this stage. However, learned Additional Sessions Judge-11, Bhojpur (Ara), is hereby directed to expedite the trial of Sessions Trial No.94 of 2015, arising out of Sahar Police Station Case No. 134 of 2014, and dispose of the same, in accordance with law, preferably within a period of three months.
This bail application shall stand disposed of accordingly.
