JUSTICE SANDEEP KUMAR ORAL ORDER 03-03-2022 At the very outset, learned counsel for the petitioners seeks permission to withdraw the present anticipatory bail application of petitioner No. 1 (Mukesh Singh) as he has been arrested.

Permitted to be withdrawn.

It is, thus, dismissed as withdrawn as against petitioner No. 1.

Learned counsel for the petitioner is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with Laheri P.S. Case No. 170/2021 registered for the offences

Patna High Court CR. MISC. No.49335 of 2021(3) dt.03-03-2022 2/2 punishable under Sections 302/120(B)/34 of the Indian Penal Code.

So far as petitioner No. 2 is concerned, she is the married sister-in-law (Nand) of the deceased and there is general and omnibus allegation against her.

Considering the relationship and also the fact that she stays in her matrimonial home, the present anticipatory bail application is allowed.

Accordingly, let the petitioner No. 2 Gudiya Devi, be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-V, Nalanda at Biharsharif in connection with Laheri P.S. Case No. 170/2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
