The petitioners apprehend their arrest in connection with Madhuban P.S. Case No. 474 of 2023 instituted for the offence under Sections 341, 323, 307, 379, 504, 506/34 of the Indian Penal Code.

Prosecution case in short is that informant was assaulted by co-accused persons including the petitioners by means of iron rod.

It has been further submitted by the petitioners' counsel that petitioners have been falsely implicated in the present case. There is inordinate delay of 5 days in lodging of the FIR. Nothing has been recovered from the conscious possession of the petitioners. From perusal of the impugned order, it would reveal that injury is caused by hard and blunt object, which does not support the allegation. There is no specific allegation attributed to the petitioners. There is general and omnibus allegation against the petitioners. Charge sheet has already been submitted in this case. Other co-accused has been granted bail by this Court vide order dated 01-03-2024, passed in Cr. Misc. No. 12583 of 2024.

On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioners.

Considering the rival submissions made by the learned counsel for the parties, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where
