JUSTICE SANJAY KUMAR ORAL ORDER 17-05-2018 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner, who is in custody since 06.03.2018 seeks bail in connection with Marhowrah P.S. Case No.367 of 2017 registered for the offences under Sections 341, 342, 323, 365, 427, 504 and 506 of the Indian Penal Code.

It is alleged that the F.I.R. named accused persons including the petitioner kidnapped one Arvind Rai. It has been submitted that the said Arvind Rai was brought to the police station with arms by the accused persons and for that a police case was also lodged against him. The other co-accused, namely, Akhilesh Rai @ Akhilesh Prasad Yadav and Shatrudhan Rai have been granted bail by one of the coordinate

Patna High Court Cr.Misc. No.23730 of 2018 (3) dt.17-05-2018 Bench of this Court in Cr.Misc.No.63501 of 2017 and Cr.Misc.No.7238 of 2018 on 19.01.2018 and 07.02.2018 respectively. The case of the petitioner stands on similar footing. The learned counsel for the informant and learned A.P.P. for the State opposed the submission.

Considering the facts and circumstances of the case, the prayer for bail is allowed and the above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the likewise amount each to the satisfaction of Shri Rajesh Singh, Judicial Magistrate, Saran at Chapra in connection with Marhowrah P.S. Case No.367 of 2017.
