The Opposite party No.2 was granted anticipatory bail by this Court by an order, dated 29.09.2016, passed in Criminal Misc. No. 41685 of 2016 in connection with Bahera P. S. Case No. 150 of 2016, registered for the offences punishable under Sections 147, 149,341,448,323,324,379,307 and 504 of the Indian Penal Code.
The petitioner is the informant of the said police case and seeks cancellation of bail. The plea of the petitioner is that the court granted Opposite party No.2 anticipatory bail on the ground that the injuries were found to be simple in nature. According to the petitioner, the injuries have subsequently been found to be
grievous in nature.
Since there is no concrete material on record to show that the Opposite party No.2 is in any manner misusing the privilege of bail, I am not inclined to entertain this application, seeking cancellation of bail.
There is no merit in this application. This application is accordingly dismissed.
