JUSTICE DINESH KUMAR SINGH ORAL ORDER 27-07-2016 Heard learned counsel for the petitioner and the State. The petitioner is languishing in jail since 23.05.2016 in a case registered for the offences punishable under Sections 20 and 22 of the N.D.P.S. Act.

From the cow shed of the petitioner, 1 kg ganja concealed in the heap of grass, was recovered. It is submitted by learned counsel for the petitioner that the recovery has been made from an open area. Moreover, the small quantity of ganja was recovered. A statement has been made in para 3 of the petition that the petitioner is accused in one other case being Special Case No. 17 of 2013 registered under Sections 20 and 22 of the NDPS Act wherein he is on bail. Learned A.P.P., Mr. J.N Thakur does not dispute the

Considering the small quantity of recovery, let the petitioner be released on bail on furnishing bail bond of Rs. 10,000(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned District and Sessions Judge cum Special Judge NDPS, Patna in connection with Gopalpur P.S. Case No. 78 of 2016.

The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in similar nature of the offence or he defaults for three consecutives occasions.
