JUSTICE SUDHIR SINGH ORAL ORDER 25-10-2016 Heard learned counsel for the petitioner and the State. The petitioner is in custody in a case registered under Sections 409.420, 467, 468 and 471 of the Indian Penal Code. The allegation against the petitioner is that by wrong means he has obtained sanction order for the three schemes and government money has been expanded in illegal way. It has been submitted on behalf of the petitioner that the petitioner is in custody since 07.07.2016. Charge sheet has been submitted in this case. The petitioner has got no criminal antecedent. There is no allegation of tampering with the witnesses alleged against the petitioner. The petitioner is a Panchayat Secretary, Executing Agent of the Schemes, in question. In para 21 of the case diary it has come that proper sanction for the work
Patna High Court Cr.Misc. No.35581 of 2016 (3) dt.25-10-2016 2/2 was obtained. Thereafter the work was executed. There is no allegation of misappropriation of public money. Other co-accused has been granted bail by a co-ordinate bench of this Court in Cr. Misc. No. 38684 of 2016.
On behalf of the State, it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheohar in connection with Sheohar P.S.Case No. 171 of 2013.
