JUSTICE SUDHIR SINGH ORAL ORDER 22-09-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 498(A) and other allied Sections of the Indian Penal Code and Section 4 of Dowry Prohibition Act. The allegation against the petitioner is of torturing the complainant for non fulfillment of additional demand of dowry. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. Further, it is submitted that both the parties have appeared in Matrimonial Case No. 208 of 2015, evidences have been adduced on behalf of the petitioner and opposite party no.2 and it has been agreed that final alimony

Patna High Court Cr.Misc. No.23334 of 2015 (4) dt.22-09-2015 2/3 has been fixed and part amount has already been paid. It is further submitted that till final decree is passed in Matrimonial case, the petitioner shall deposit an amount of Rs. 500/- (five hundred) per month in the court below, which may be released in favour of the complainant.

On behalf of the State and counsel for the complainant, it has been submitted that the petitioner is the husband of the complainant.

Considering the aforesaid facts, it is directed that the petitioner shall deposit an amount of Rs. 500/- (five hundred) per month in the court below till final decree is passed in matrimonial case, which shall be released in favour of the complainant. Let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Madhubani in connection with C.R.No. 1694 of 2013, subject to the conditions as laid down u/s 438(2) Cr.P.C.
