The petitioner is in custody since 23.01.2016 in connection with Sheikhpura (Kusumbha) P.S. Case No. 23 of 2017 for the offences punishable under sections 25(1-b) a/26(ii)/35 of the Arms Act.
From perusal of Annexure-1 it appears that one country made pistol and two live cartridges were recovered from the possession the petitioner. It also appears that the co-accused Indal Yadav, who is similarly circumstance accused in the same police station case having similar allegation, was granted bail by this Court in Cr. Misc. No. 19377 of 2017 vide order dated 10.05.2017.
Patna High Court Cr.Misc. No.22324 of 2017 (3) dt.07-06-2017 2/2 In view of the fact that the similarly circumstance co-accused was granted bail by this Court in Cr. Misc. No. 19377 of 2017 vide order dated 10.05.2017, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura or Successor Court in connection with Sheikhpura (Kusumbha) P.S. Case No. 23 of 2017, subject to the condition that the petitioner will extend full cooperation in conclusion of the trial and he will not, in any manner, influence the witnesses.
