JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302, 323 and 504 of the Indian Penal Code.

Petitioner is not named in the First Information Report but in course of investigation, the name of the petitioner came in confessional statement of co-accused Shyamdeo @ Shyamdeo Yadav and accordingly, the petitioner was arrested and charge sheeted in the present case.

Submission on behalf of the petitioner is that the informant in his fardbeyan claims that it was co-accused Baiju Mandal, who shot fire on the deceased and moreover, having more

Patna High Court Cr.Misc. No.30908 of 2016 (2) dt.09-08-2016 2/2 or less similar allegation, co-accused Jhabbar Marick @ Jhabbar Yadav has already been granted privilege of bail by co-ordinate Bench of this Court.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Narpatganj P.S. Case No. 185 of 2014.
