The petitioner seeks bail in connection with Shugahauli P.S. Case No. 04 of 2017, registered under Section 30(a) of Bihar Excise Act.
The accusation is that on receiving secret information about carrying of illicit liquor from a Scorpio and Tempo, the informant and other Police personnel proceeded for raid and the said vehicles were intercepted. On seeing the Police personnel, some persons started fleeing, but they were apprehended by the Police, who disclosed their names as Sug Mohammad (Petitioner), Sadam Hussain, Mukesh Kumar, Khurshed Alam and Birendra Sahani. On search of Tempo, 225
Patna High Court Cr.Misc. No.18636 of 2017 (2) dt.05-05-2017 2/2 bottles, each containing 180 ML India made foreign liquor recovered, whereas from the search of Scorpio, 125 bottles, each containing 375 ML India made foreign liquor recovered. On the disclosure of the petitioner, 432 bottles, each containing 750 ML India made foreign liquor recovered from Gayaghat Dhobi Ghat. Learned counsel for the petitioner submits that petitioner has no criminal antecedent and he is in custody in the present case since 13.01.2017.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari in connection with Shughauli P.S. Case No. 04 of 2017. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
