The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 201/34 of the Indian Penal Code and Section 27 of the Arms Act. As per the F.I.R., the allegation is that dead-body of informant's husband was found lying in water under the bridge and petitioner alongwith other co-accused persons have been made accused on suspicion.

It is submitted on behalf of petitioner that save & except suspicion, there is nothing against this petitioner. There is no eye-witness to the alleged occurrence. Some of the other similarly situated co-accused persons have already been granted bail by this Court. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.49440 of 2021(2) dt.21-06-2022 2/2 Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 1st , Udakishunganj, Madhepura / concerned court in connection with Alamnagar (Ratwara O.P.) P.S. Case No. 154 of 2015, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
