The petitioner seeks bail in anticipation of his arrest in connection with Barauni (Garhara O.P.) P.S. Case No. 46 of 2020 instituted for the offences under Section 30(a) of the Bihar Prohibition & Excise Act, 2016.
Patna High Court CR. MISC. No.36941 of 2020(2) dt.08-04-2021 2/3 It appears from the prosecution report that 823.56 litres of liquor was recovered from the house of one Ranjit Paswan. Aforesaid Ranjit Paswan has named the petitioner along with other persons as partners in the offence.
Learned counsel for the petitioner has submitted that nothing has been recovered from his possession and he does not have any criminal case against him lodged in any one of the police stations of the State of Bihar. Some of the other accused persons of this case, who are similarly situated have been granted bail by this Court.
Considering the afore-stated facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II-cum-Special Judge, (Excise Act)
