The petitioner apprehends her arrest in Vaishali P.S. Case No.173 of 2019 registered under Sections 147, 148, 149, 341, 353, 332, 333, 307 and 504 of the Indian Penal Code. The informant, in sum and substance, alleged that while he and other police officials were on patrolling duty, the informant got secret information about serving toddy in a hut. On such information, the informant reached there. Seeing the police, some persons, who were taking toddy, fled away but the toddy seller remained present. On search, no country made liquor was found. The toddy seller disclosed his name as Tunna Ram. The police advised him not to sell toddy. While the informant was returning and he reached near village
Patna High Court CR. MISC. No.36415 of 2020(2) dt.13-04-2021 2/3 Shahjahanpur Tola Tikahai, 40-50 persons surrounded the police and they assaulted the informant and others. Chowkidar Nagina Rai is said to have identified the petitioner and others. Learned counsel for the petitioner submits that the petitioner is a lady. At the instance of Chowkidar, the petitioner has falsely been implicated in the case. All the accused persons similarly situated have already been granted bail vide order passed in Cr.Misc.No.44636 of 2019, Cr.Misc.No.52951 of 2019, Cr.Misc.No.55849 of 2019, Cr.Misc.No.60094 of 2019 and Cr.Misc.No.67122 of 2019. The case of the petitioner stands on the same footing.
Taking into consideration the facts that most of the accused persons, who are similarly situated, have already been granted anticipatory bail by different benches of this court and the case of the petitioner stands on the same footing, the petitioner, above named, in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali in connection with Vaishali P.S. Case No.173 of 2019, subject to the
