ANJANA MISHRA ORAL ORDER 04-05-2018 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner is in custody since 21.01.2018 in connection with Forbesganj P.S. Case No. 42 of 2018 for the offence registered under Sections 413 and 414/34 of the Indian Penal Code.
Learned counsel for the petitioner submits that save and except suspicion that he was one of the persons, who was fleeing away after leaving the motorcycle, the petitioner has been taken into custody. It is further submitted that the petitioner is merely a hawker and has no concern with the recovery of motorcycle.
Diary of the present case was called for which has since been received.
Patna High Court Cr.Misc. No.22056 of 2018 (3) dt.04-05-2018 Learned counsel for the State, after perusal of the case diary submits that admittedly, he was not arrested along with the motorcycle but he is said to have fled away from the place of occurrence and further there is no material available in the case diary.
Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 42 of 2018.
