The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.

As per the prosecution case, this petitioner alongwith other F.I.R. named accused persons assaulted the informant and his son, due to which, both persons got injured. It is submitted on behalf of petitioner that both parties are gotiyas and due to land dispute between them, a scuffle took place, in which, informant and his son sustained simple injury. The allegation of assault is general and omnibus and petitioner has got clean antecedent.

Learned A.P.P. for the State has opposed the bail petition.

No.49173 of 2021(2) dt.21-06-2022 2/2 Considering the backdrop, in which, the incident took place and the fact that petitioner has got clean antecedent, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M.1st Class, Saran at Chapra in connection with Khaira P.S. Case No. 101 of 2021, corresponding to G.R. No. 2109 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
