This application is for grant of regular bail in connection with Motipur Police Station Case No 367 of 2016 for the offences under Sections 395, 379 and 412 of Indian Penal Code.
It is submitted on behalf of the petitioner that petitioner is named in the first information report. It is further submitted on behalf of the petitioner that except the fact that the petitioner is named in the FIR, there is nothing against him. Nothing has been recovered from his possession and he has not been put on test identification parade and later on, there is a confessional statement of petitioner himself in this case. It is further submitted that petitioner is in custody for about four

Heard learned APP also. Learned APP opposed the prayer stating that the petitioner is named in the FIR and allegation is there in his confessional statement also along with the fact that four other such type of cases have been registered against him. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. However, the learned trial Court is directed to expedite the trial.
With the aforesaid observation, this application is dismissed.
