JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 26-10-2021 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Bpusi P.S. Case No. 75 of 2020 registered for the offences punishable under Sections 436, 504, 506/34 of the Indian Penal Code.

Petitioner no. 1 and petitioner no. 2 are brother and sister.

The allegation against both the petitioners is that they sprinkled kerosene oil in the house of the informant which was extinguished by the informant after some effort. Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.38462 of 2020(3) dt.26-10-2021 2/2 that the petitioners are innocent and they are students. The allegation of sprinkling Kerosene oil on informant's house and setting on fire is absolutely false. The petitioner no. 1 has earlier filed Bousi P.S.Case No. 49 of 2018 under sections 447,341,323,379,504/34 of the Indian Penal Code against the informant and others.

From perusal of the F.I.R, it transpires that no description of article which have been burnt has been mentioned in the F.I.R.

In the above mentioned circumstances, let petitioners in the event of their arrest/ surrender within six weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Addtional Chief Judicial Magistrate, 1st Araria in Bousi P.S. Case No. 75 of 2020 subject to condition as laid down under Section 438(2) of the Cr.P.C.
