The petitioner seeks bail in connection with Kajraili P.S. Case No. 40 of 2024, instituted for the offences punishable under Sections 304B/34 of the Indian Penal Code. 3.

The prosecution case, in short, is that, daughter of the informant has committed suicide due to torture on account of non-fulfillment of the demand for dowry by her in-laws. 4.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. Charge-sheet has been submitted in this case.

No.38435 of 2025(2) dt.24-06-2025 2/3 Learned counsel for the petitioner also submits that the petitioner is not the in-laws of the deceased and was not present at the place of occurrence. The petitioner never made any demand of dowry. There is general and omnibus allegation levelled against the petitioner. No specific allegation has been attributed against the petitioner. It is next submitted that the deceased has committed suicide. On perusal of postmortem report, it transpires that the cause of death is asphyxia. The petitioner is in custody since 11.12.2024 and has got no criminal antecedent. Learned counsel for the petitioner further submits that similarly situated co-accused has been granted regular bail by this Court vide order dated 28.02.2025 passed in Cr. Misc. No. 7588 of 2025.

Learned APP for the State has vehemently opposed the prayer for grant of bail to the petitioner. 6.

Considering the aforesaid facts and circumstances of the case and taking into account the period of custody undergone by the petitioner, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Court
