Let this order along with the case diary be placed before the Superintendent of Police, Siwan and learned C.J.M., Siwan for the needful.

Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 120(B), 406 and 409 of the Indian Penal Code.

Patna High Court Cr.Misc. No.13276 of 2012 (5) dt.13-02-2015 2/2 It is alleged that the trucks were being hired by the State Food Corporation but the three trucks loaded with wheat went missing.

It is submitted by learned counsel for the petitioner that the petitioner is not responsible for mis-conduct of the driver and the petitioner has also lodged a complaint against the drivers. Moreover petitioner's Bank Guarantee of Rs. 5 lacs and Sureties of Rs. 3 lacs are still lying with the State Food Corporation. Learned counsel for Food Corporation submits that missing wheat was worth about Rs. 15 lacks. Considering that the Bank Guarantee and Surety amount are still lying with the State Food Corporation, which shall be subject to the result of the case, let above named petitioner be released on bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Siwan, in Muffasil P.S.Case No. 356/2011, subject to the conditions as laid down u/s 438(2) Cr.P.C.
