JUSTICE ARVIND SRIVASTAVA ORAL ORDER 06-04-2017 Heard learned counsel for the petitioner, learned counsel for the informant and learned counsel for the State. Petitioner is accused in connection with Kishanganj P.S. Case No. 239 of 2016 registered under Sections 363, 366A/34 of the I.P.C.

Learned counsel for the petitioner submits that no material has come showing complicity of the petitioner. There is no eye witness of the alleged occurrence. Petitioner is in custody since 29.09.2016.

Learned counsel appearing for the State and the informant opposes the prayer for bail and submit that there is direct allegation of kidnapping against the petitioner and the kidnapped girl has not been recovered till date. Having considered the facts and circumstances of the

Patna High Court Cr.Misc. No.7753 of 2017 (3) dt.06-04-2017 2/2 case, the nature of allegations levelled and the submissions advanced on behalf of the parties, I do not feel inclined to grant the privilege of bail to the petitioner. His prayer for bail is, therefore, rejected.
