1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 223,316(2),318(4),119(1),61(2),3(5) of the B.N.S. and Section 3 of Damage of Public Property Act.

3. The learned counsel for the petitioner submits that the petitioner has antecedent of eight cases and the informant alleges that on 17.03.2025 at about 1.00 P.M., he along with S.I. Suraj Kumar Singh along with the armed force had gone to inspect the plots acquired by the housing board at Rajiv Nagar Road No.24D, when it was found that construction material were kept on the land belonging to the housing board with an

Further, on enquiry, the informant got information that the said construction materials have been collected on the plot by the accused persons including the petitioner as they intended to take forceful possession over the land of the housing board.

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is further submitted that no doubt, petitioner has antecedent of eight cases, but then, in all eight cases have been instituted in Rajiv Nagar Police Station and the offences alleged are also similar to what has been alleged in the instant case. It is next submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence.

5. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-II, Patna in

Patna High Court CR. MISC. No.37645 of 2025(2) dt.18-06-2025 3/3 connection with Rajiv Nagar P. S. Case No.243 of 2025, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
