JUSTICE SUDHIR SINGH ORAL ORDER 09-07-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners apprehend their arrest in connection with Jalley P.S. Case No.157 of 2014 registered under Sections 295(A)/34 of the Indian Penal Code.

As per F.I.R., the petitioners along with Gulab who carrying bag in hand were going together towards temple premises and informant and others suspected that what they were carrying towards temple and informant and others asked as to what they were carrying, all fled away throwing the bag containing beef. It has been submitted on behalf of the petitioners that it has not been ascertained whether the meat which is alleged to have been carried by the petitioners, was cow meat or any other meat. Further it is submitted that merely on suspicion, the petitioner is named in the FIR. It is further submitted that the informant and the petitioners are co-villagers and due to village

Patna High Court Cr.Misc. No.21696 of 2015 (2) dt.09-07-2015 2/2 politics, they have been falsely implicated in the present case. It has been submitted that the matter has been settled between the parties and in respect to that, a petition has already been filed in the court below.

On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the facts and circumstances, the petitioners, named above, in the event of their arrest/surrender in the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Darbhanga in connection with Jalley P.S.Case No.157 of 2014, subject to condition as laid down under section 438(2l of the Cr.P.C.
