This M.J.C. application has been filed by the petitioners for restoration of Second Appeal No.06 of 2008, which was dismissed for default for non-compliance of peremptory order. It is admitted fact that the second appeal has already been admitted.

In view of the submission of the learned counsel for the petitioners and the statements made in the M.J.C. application, this restoration application is allowed and Second Appeal No.06 of 2008 is restored.

Learned counsel for the petitioners submitted that he will file necessary requisites for issuance of appeal notice on respondent nos.1 and 3 to 14, as directed earlier in second appeal, within two weeks from today.
