05.08.2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in a case registered for the offences under Sections 47, 54 and 57 of the Bihar Excise (Amendment) Act, 2016.
The petitioner is said to be caught red-handed while she was preparing country-made liquor and it is alleged that eleven litres country-made liquor and other articles were recovered from her house. Petitioner is in jail custody 02.05.2016 and submission on behalf of the petitioner is that as a matter of fact that petitioner was caught by the police official as she was found alone in her house. It has further been submitted that petitioner was never engaged in preparing the country-made liquor.

No.30606 of 2016 (2) dt.05-08-2016 Considering the aforesaid facts and circumstances, the submissions of the parties as well as this aspect of the matter that petitioner being lady is in jail custody since 02.05.2016 and she does not have any criminal antecedents, let the Petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Naugachia, Bhagalpur in connection with Parbatta P.S. Case No. 37 of 2016.
