The Divisional Commissioner-cum-Arbitrator under Section 20F(6) of the Railways Act, 1989 is authorized to dispute between the Dedicated Freight Corridor Corporation of India Limited and the petitioner.

Learned counsel for the petitioner is permitted to withdraw this application so that she may file her claim before the Divisional Commissioner-cum-Arbitrator, Patna under

Patna High Court CWJC No.10935 of 2022(2) dt.12-09-2022 2/2 Section 20F(6) of the Railways Act.

The learned counsel for the State and DFCCI Limited have no objection to the same.

The writ petition is permitted to withdraw with the liberty the petitioner to move Divisional Commissioner-cumArbitrator, Patna within thirty days from today. The Arbitrator will decide the matter within six months after hearing the parties and pass a reasoned order in accordance with law. He will consider all the claims of the petitioner including the objection. All the evidences produced by the petitioner shall be considered and dealt by the Arbitrator in his final order.

With the aforesaid observation and direction, this writ petition is disposed of.
