JUSTICE SANJAY PRIYA ORAL ORDER 10-03-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Chhauradano ( Mahuawa) P.S.Case No.101 of 2016 registered for the offence under Sections 272, 273/120(B) of the Indian Penal Code and 47(A) of the Bihar Excise Act.

It is alleged that 600 bottles of Nepali wine of 300 ml. each was recovered from Scorpio car of which the petitioner was the driver.

The petitioner is said to be in custody since 16.09.2016. As per para 3 of the petition there is one other case pending against the petitioner in which he is on bail. Keeping in view the period of incarceration of the

No.8702 of 2017 (2) dt.10-03-2017 2/2 petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Raxaul at Motihari, Champaran, in Chhauradano (Mahuawa) P.S.Case No.101 of 2016, subject to the condition that both the bailers shall be the close relatives of the petitioner.
