JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Section 47(a) of the Bihar Excise Act.

Several bottles containing near about 27 litres Indian made foreign liquor are said to have been recovered from the house of the petitioner for which petitioner is in jail custody since 9.6.2016. Petitioner does not have any criminal antecedent and submission on behalf of the petitioner is that even if the aforesaid accusation assumed to be true, then also, the aforesaid recovery has been made from a joint house.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner above named

Patna High Court Cr.Misc. No.33833 of 2016 (3) dt.24-10-2016 2/2 be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Siwan in connection with Siwan Town (Sarai O.P.) P.S. Case No.386 of 2016.
