JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 24-12-2013 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner apprehends arrest in a case registered for the offences punishable under sections 498A, 324, 307, 341 of the Indian Penal Code and section 3⁄4 of Dowry Prohibition Act to which section 304B was subsequently added.
The petitioner is the mother-in-law of the deceased. It is submitted on behalf of the petitioner that, in course of trial, the father and mother of the deceased had already been examined and they have not supported the prosecution story. He has referred to annexure-2 to this application in support of his submission.
In view of submission as above, let the petitioner,
Patna High Court Cr.Misc. No.44443 of 2013 (3) dt.24-12-2013 2/2 above named, in the event of her arrest/ surrender within a period of six weeks from today be released on bail on her furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Naugachia in Naugachia (Mahila) P.S. case No. 25 of 2012, subject to conditions as laid down under section 438(2) of the Code of Criminal Procedure.
