JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Sasaram Rail P.S. Case No. 104 of 2017 for the offence under Section 306 of the Indian Penal Code.

In this case diary was called for vide order dated 09.05.2018.

Learned counsel for the State submits that after going through the case diary one cannot safely make a statement that the petitioner is the abettor in the matter of suicide. The petitioner is in custody since 18.02.2018.

Considering the fact that the petitioner has no criminal antecedent and also the fact that there is no clinching material to establish that the petitioner has abetted the commission

Patna High Court Cr.Misc. No.28269 of 2018 (4) dt.05-07-2018 2/2 of suicide, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate (Railway), Gaya in connection with Sasaram Rail P.S. Case No. 104 of 2017.
